I'm on H1b visa in my 6th year. Perm application has been filed and I hope to get it approved soon along with approved i-140 (fingers crossed).
From what I have read on this forum so far, H1b transfer to a new job after an approved I-140 seems to be possible even after 6 years on H1. My issue is that I currently work for a university (non-quota H1) so if I get a new job most likely it will be with a for profit company which would require me to get a new H1 (and not H1 transfer).
So, the question is whether it is possible to get a new H1 after 6 years on H1?

This year a record number of 15 million foreign applicants entered (http://www.cbsnews.com/stories/2010/11/22/national/main7078653.shtml) the green card lottery system which only hands out 50,000 green cards each year.
The lottery program was established by the State Department back in 1990. Participation in the lottery has grown steadily as people in the developing word have gained increasing access to the internet. The month long enrollment period ended on November 3. Many people apply year after year since there is no limit on the number of times you can apply. The only rule is that only 7% of the winning applicants may come from any one country.

You could be in H1 till Dec 2010. Nothing in the law states that your already approved H1 has to be revoked, with the PERM denial.

The Comprehensive Immigration Reform bill introduced in the House of Representatives would revamp the existing employment-based (EB) preference system in a number of important ways: 1) Recapture � Currently, 140,000 persons are permitted to immigrate to the U.S. each year under the EB preference system. My wife is joining me on a H4. I plan to get her visa converted to H1 and my company is ready to sponsor her visa for conversion. Pls let me know if H4 to H1 visa is a tough thing. And also is there is last date we have to file the papers for this?? is it treated as a regular h1 quota or it lies outside of the quota and can it abe applied anytime??
She has a 16 yrs degree and has work exp which qualifies her for visa.

Hi Sukhpreet, are you sure the actual petition was filed and denied, or just the labor condition application (LCA) was denied? The LCA is one component of the H-1B petition; it requires a valid FEIN number, and it needs to be certified in order for the H-1B petition to be filed. Most likely, this is what has been denied because the DOL could not find/match the number. The lawyer can just refile the LCA with the appropriate IRS documentation, and it should be certified within a week. The H-1B petition can then be filed with the certified LCA.

They also updated information on their site about backlog.
USCIS: National Processing Volumes and Trends (http://dashboard.uscis.gov/) .
Backlog for I 485 pre adjudicated application went up by 20k. USCIS has mentioned few times that they will pre adjudicate all cases by Oct 2009. So we may see increase in those number till Oct 2009 posting. After that we will see reduction. How much reduction.. No one can guess. But definitely EB2 will not get more than 25k per year so it will be easily 5 years to clear all backlog for Eb2. Number may go up because of Eb3 - Eb2 porting after one year when they get their labor approved.

In above link, how is it possible to have pending I-485 (EB2) for 2008 & 2009 for India? If i remember correctly the priority date for India has reached upto Jul 2007 only so far.

I had an H1 for about 3 years (2 different employers), and then was hired by an international organization. I gave up the H1 and got a G4 visa, which I still have. Over the last 3 years with a G4, my credentials have changed, and am due to get my masters degree in May 2008. If I were to move to a job requiring H1 when I get my masters, will the total number of years allowed for me to hold an H1 roll back to 6 years? I'm thinking that since the skills I had as an H1B visa holder before have changed now.
