I got my labor and 140 cleared few months back under EB3, Can I apply for 765 to get my EAD ?
I have not applied for 485.

Thanks to Googler,
i called TSC and after about 10 mins or wait, i was directed to a very nice lady. Who basically told me that they are processing April 30 application adn since mine is august RD, I have about 4 more months before they look at my file. So to answer, they do go by RD and not ND. She also tole me that my name check has been cleared. Its a matter of time now.
I have not seen any updates on my case, since the LUD after FP. I do have a criminal issue, so I anticipate an interview. However, i have forwared all my court docs to them when i applied for 485. some attorneys tell me that interveiw may not even be needed since they have all the court docs. It was for a DWI 8 years ago.

I already have my 485 pending at NSC. My state comes under TSC jurisdiction.
Where should i file for my EAD, if I don't file concurrently with 485? at NSC where my 485 pending or at TSC?
What are the documents I need to file for EAD?

Hi,
I'm GC holder and i've applied for reentry permit and the validity is 2 yrs.
I've been living in INDIA for the past 10 months and now i want to go back to US.
I'd been filing my taxes and all but was not working for any US company for the past 10 months.
Will there be any issues at the POE when i return to US?..Usually POE officer asks the questions like where do you work and what was the reason you went to INDIA..
Is it Ok to tell the officer that i'm not working?
Please share your thoughts

Guys, I need ur suggestion and experiences on my typical situation
I am in the process of going full time with my client.
I have my I-485 Filed in July 2007 & have EAD & AP
I am not in a position to use EAD as I got married after I filed for I-485. I have to stay on H1B to maintain my wife's H4 status.
my Client's Attorney is filing for H1B transfer and is suggesting that I can use EAD to start working as soon as he files for H1B transfer.
My understanding is I will loose H1 status if I use EAD, hence H4 will be invalid.
Was anybody in a similar situation ?
I don't want to take a risk by using EAD and my wife loosing H4 status.
Please advice

Hi,
I applied for EAD renewal to Nebraska center on Dec 12th.
So far I didn't received the receipt and also my check didn't get cashed.
Did anybody encounter similar situation. If so please let me know what you have done.

Now that USCIS has dropped bomb by announcing the revised bulletin, do you think now they will be able to bring back the premium processing for I-140? or still they dont have time to "ensure" processing in 15 days.

It seems quite a few individuals with older priority dates from 2003 & 2004 are still waiting for a decision on their RiR cases (both state and regional) from Dallas BEC. It has been recently reported that many of these cases have received RFE's from BEC on a variety of issues (they might also have had an RFE at state or regional). I think it would be advantageous for all of us in similar situation if we can anonymously post the type of RFE's we receive and possible ramifactions for the same.
If some one knows of a similar thread elsewhere please provide a link, that way we can avoid duplicates.

I was in a similar situation and my lawyer advised to apply for H1 (come April) even without the H4 extension. A query will be sent asking to prove your status until atleast Sep 30th. You can then attach your H4 papers (assuming your H4 extn is approved by then).
Anyway, i am planning to apply for extension using premium processing just to make sure things progress smoothly.

You can status will be Adjustment of Status ( AOS ) but cant work . IYou need a APO if you want to travel . If you want to work you need an EAD .
Check with attorney .This is the essence of mail which i got from my attorney when asked regarding my son status
