Hi,
My brother is coming to USA on L1 visa.
His wife has a valid H1-B stamped. However, her employer cannot send her to US for the next 6-7 months.
Can she come to US on L2 and then transfer her H1-B if whe finds a job here in US? Or will her H1-B get immidiately cancelled as soon as she enters US on L2?

I'm in the process of a COS and was denied an R1 petition. Here's my case, and it would greatly help me if someone could assist me in determining whether my countdown of unlawful presence and unlawful status has begun.
Aug 15, 2004 Arrived on a F1
Jul 21, 2009 F1 expired
Aug 20, 2009 Filed for R1
Aug 24, 2009 OPT expired
Nov 18, 2009 R1 status denied
Dec 18, 2009 Appeal of Decision
After the expiry of my OPT i still continued to work whilst my R1 petition was in process. Does this violate my status automatically, or does it begin when it is determined by the USCIS? If it does, does my 180 days countdown to unlawful presence begin from Aug 24, 2009, or from the denial of my R1 petition? Is it true that they really approved 60000 cases in June. I have a couple of friends that filed I-485 in 2005 and there background is clear too but still have not been approved. I don't understand what is going inside the blackbox. I read in forum that only 40,000 application were ready for approval but then why didn't these people application was not approved all thou there file was complete.

I am taking up a new job... The pay is good (10% more) and position is also of a senior lead developer.. I am not even leaving the area.. The company is 5 times bigger than my current one... I have an EAD card valid till Sept end 2008....What is your opinion. Should I go for the new offer? I am worried if anything will happen to my GC processing. Please help me make a decision.. Thanks as always...

Keeping in view the current and anticipated situation in Oct 2007, would priority date transfer help me at all or I will have to face same processing times?
My assumption is that visa numbers will be unavailable from Aug 17th to Oct '07 and when the new visa number become available, the dates will retrogress to 2003 or 2004 ... who knows. So using old PD may earn me advantage in that case.

Currently my 485 is pending over 1.5 years with I-140 approval (2007). I was laid-off. I have valid EAD card. Am I eligible to transfer to a TARP company for a similar position but in different state? Is there any specific policy or limitation for this work status? The company's HR couldn't make a decision. What should I do? Thank you very much for your kind and generous help.

I was H1B, but used AP return to the U.S. the same company, but when I filed the new I-9 form after return, the company lawyer asked me to write EAD and EAD expiration date, so I guess I am AOS now? or not? I am not sure. My company will resume my H1B this month, but don't know when it will be completed.
Now I am going to e-file EAD renew.There are some questions in the form I-765 that I am not sure how to answer (The lawyer has completed his 140 and 485 document, so he doesn't want to answer now.):
1, Manner of Last Entry into the U.S.: Should I choose PAR (PAROLEE) or H1B (SPECIALITY OCCUPATION)?
2, Status: Should I choose PAR (PAROLEE) or H1B(SPECIALITY OCCUPATION)?
3, Please select your eligibility status : Should I choose (a) (4) PAROLEE or (c) (9) FILED I-485?
