I had a chance to get to know Genia Brin, Google founder Sergey Brin's mom, when we jointly served on the board of HIAS. She's an impressive woman who could sit back and relax, but instead she goes to work everyday as a NASA scientist and works on climate and forecasting projects for our nation's space agency. hello,
Unfortunately a person with a pending form I-130 is not eligible to receive a work authorization. I-130 itself does not give you the legal authority to USCIS to issue a work permit. It is possible to get a work authorization if such a person has a pending I-485 (Adjustment of status) or is in other valid immigration status that would allow him / her to get work authorization.

Mr. Obama might want to consider transferring the authority of setting quotas from Congress to the Labor Department
May be good or bad, depending on how you look at it....we will then be at the mercy of PERM...
If the Labor Department determines that a foreign worker would not displace Americans, that worker should not be barred from entering the country due to an arbitrary quota
This should definitely be high on the agenda.....although its very doubtful if this can ever be implemented.

Hi,
I am on H1B and still 4+ years are left on my new H1. I have got my I-140 EB2 cleared in July 07 and applied for I-485 in Aug. Got EAD in Oct.
My question is what is the better option out of the following to change employer:
1. To transfer H1B to new company with the same Job Title as was in previous H1B. I have good relation with my existing employer.
2. Or I can invoke AC21 and start working on EAD with new employer (after 180 days).
Questions:
Q1: If I want, can I come back to my existing employer on same old H1B (if thats still valid) ?
Q2: I frequently go to India (at-least one time in a year). So with EAD and AP, there might be more waiting/ filing each year etc.
Q3: Which is the better option for me - H1B or EAD ?

Hi,
I am filing the PERM application in EB2 Category. The position needs Bachelors + 5 Years (or) Masters + 1 year. I do have 30 months expereince after finishing my Bachelors degree and 11 months expereince after finishing my Masters degree.
Will I be eligible to file in EB2 as I have Masters degree and more than 12 months of expereince after Bachelors.
My questions is -- How do you count the expereince if its Masters + One year
Will you count one year after finishing the Master Degree completed (or)
Will you count one year after finishing the Bachelors Degree.

My ex employer (ABC) applied for my green card in 2006. In 2007, I got my 140 approved and I applied for 485. In 2009, I changed jobs using my EAD. ABC still holds my H-1b. Also, I did not file for AC21 yet.
ABC still owes me close to 25k in back pay. I want to report them to Dept of labor and get my money back. What are my options and what are the ramifications of doing so on my green card process?

If you don't need it. You don't have to apply for AP. You can apply when you need it.

Guys,
Please help me...I do not have much knowledge about GC process. I am working on H1B visa from last 3 years with my current employer and they are ready to apply for GC but, I know that for GC in the same position I cannot use the experience gained during past 3 years. But if I apply for GC for the next level (as GC is for future employment) with the current experience and keep working in my current role until my GC is approved, do you guys see any problem with that? GC approval will easily take 4-5 years and during this time I can keep working in my current position and once GC is approved I can switch to the next level which is kind of promotion.

I applied for my AP in June and recently at the end of August my AP was approved. I received the AP a couple of weeks later in mail. However I noticed that instead of receiving the I-512 Authorization of Parole of an Alien into the United States, I received an I-797C Notice of Action document for me an my wife. The contents of this I-797C are exactly the same as the previous I-512s that I have filed for and received over the years.
What I am afraid of is that this may cause problem at the port of entry when I return back from India because of the wrong title of the document.
Has anyone else received such a a document I-797C instead of I-512 and is it safe to travel having such a document? Any advice/input is appreciated.

I work for a non-profit State University (6+ years), and my supervisor is letting me work from Canada for a year or so. As my university HR needs to have an H1B permit to keep me on the payroll, my University's International Officer is willing to keep my permit valid and keep renewing it even beyond 6 years as my I-140 is approved. She says that I can also apply for an H1B visa in Canada and visit US whenever my supervisor asks me to do so.
Wondering if this is doable without violating the USCIS & LCA rules and regulations? Thanks.
