Unfortunately a person with a pending form I-130 is not eligible to receive a work authorization. I-130 itself does not give you the legal authority to USCIS to issue a work permit. It is possible to get a work authorization if such a person has a pending I-485 (Adjustment of status) or is in other valid immigration status that would allow him / her to get work authorization.

Here is my case details
In US from Feb 2000 - till date
PD :Aug 2002
I140 approved on Aug 2004 (no rfe)
I485 rcpt :sep 2005 pending for approval...
worked with Company A and 2002,2003 w2's are way too low 9k and 25k. Went to home country for vacation 3 times on 2004, 2005.
my 2000,2001, 2004,2005,2006 till looks okie.. I dont have any other overstay or other issue.
Applied I485 on
2005. I guess my attorney filed my 2003 w2 with my i485 petion.
I chaged from company A to company B on 2005
Will im in trouble? UN or somebody can please help?

At the time of granting Green Card, USCIS may RFE request for evidence. What exactly do they need me to provde, in particular when AC21 is involved?
Just employment letters? Or do they need pay stubs from the NEW employer as well? Then only the most recent paycheck or the whole history of payroll information with the NEW employer?
Appreciate your help.
In my case, I-140 was approved, and I-485 submitted over 180 days. Then I plan to invoke AC21 working for a new employer with similar job.

Hi,
I am planning to apply for Alberta Nomination Program under NOC (Manufacturing and Industrial Engineers). Does anybody has any experience with this NOC. Also, I need to know how does this process work. I apply for ANP and when I need to move I apply for jobs and then I get work permit...right ? Then if I need to get a TN visa to come back to usa how do I do that. I have a house in chicago, so wondering if renting that out could be an option for me when I immigrate to alberta so that when I need I can come to chicago. I am in my 5th year of H1B and with the current scenario my present company is not going to start my GC (it stopped because of layoffs in the company).

In preparation to file I485, we just had medical tests and the doctor checked the box " Applicant does not meet immunization requirements" in my son's report citing the reason insufficient dates.
What is the impact of this ? How this can be remediated ? Any suggestions by those who experienced similar situation would be greatly appreciated.

Yes, you have to file a change of address form.
Also make sure your employer files an LCA for the new location.

Hi all!
I'm currently working on a personal project of mine (word processor) and there are a few things i cannot seem to get my head around and i think that they are very simple to do too...Maybe... First, I'm trying to open a new instance of my program by simply clicking a menu option on my form. i'm using visual c# 08 express edition, windows forms application... I have attached an image (very small image) to show u what i mean.. i'd appreciate anyone's help/advice on this, thanks for reading :-)

Hi.
My Wife is currently in H4 Visa and in US now. She has total of 11 years IT experience. She lastly worked with a Company X from May 2004 to May 2008 for about 4 years. Currently she is not an employee of Company X and also not working anywhere.
If the same Company X gives an US offer, Is it possible for the Company X to file L1 visa for her so that she can start working for that company immediately ? ( I have read in immigration forums that the L1 Visa Eligibility is that the person should have worked for that company for atleast 1 year within the last 3 years)
Experts, Can you pls give your opinion and suggestion on this ? If so, how long the process takes place for transfering from H4 to L1 visa ?

Today , an officer from Homeland Security visited my office.
The guy showed his Identity Card and was looking for me and the my boss (who signed the Visa Papers). He took me privately in a conference room and asked me questions like my pay, my duties, who paid for H-1 renewal etc.
Then he went to our HR dept and asked a few questions regarding my employment history. He asked me if you are treated well in this company. ( Note: Mine is not a consultant company) Anyways the guy was very polite and he told me its just a formality from homeland security
also he took picture of my desk
On searching more on this I came across this site

I need to renew my H1 for the 9th year and was wondering if I need to pay the ACWIA fee of $1500. It seems employers who are filing for a 2nd extension are exempt from paying. Does it apply also to cases beyond the 2nd extension?

A little too much desaturation, I think. Since you've kept as much red in her top as you did, you should keep a little bit of the color in her skin, otherwise it looks a little unbalanced. Her skin looks too cool in comparison.

Will it be ok to change employers multiple times on EAD with in shrt span of time difference?
yes, after being a 'chicken' for so long, I changed job on AC21 six months back. And since then changed twice after that. (once forced due to economy, second time moved to a better position) in fact now I am loving the freedom that comes with EAD. Only make sure you stick to same profession (programming) other things like salary or job title etc doesn't matter. Good Luck!

I've been visiting forums for the past 2 weeks since my petition at CSC is pending under Premium Processing. I don't think this is accurate especially for I-129 pending at CSC, VSC as I see in the forums that for several people its taking more than 2 months for regular H-1B.
IN my case, I filed under PP at CSC on 25th May. They received via fedex on 27th May, but they issued me a receipt on 6th June only. Going at all the forums, it appears its happening with everyone. Then they issue a RFE on the 14th day of the receipt.
