Please be aware that W2s at 140 stage are mainly asked to judge the "ability to pay" of the employer. There can be other reasons too.

I recently received an RFE - I 140 and USCIS is asking for all the W-2's from 2004 - till date as i came to U.S.A in November 2004. I got my SSN in Jan ' 2005 and i have all the W-2's from 2005. I am currently unable to understand what to do in this situation. Did anyone had the same problem like me. Please shed your thoughts on this. :confused: :mad:

Hello All,
I received a "Notice of intent to Revoke " on my approved I-140 recently. By gods grace, my company was able to get my I-140 reaffirmed.
The status on the USCIS website states as follows.
".....we mailed a notice to you reaffirming the approval of this case and returned the case to the Department of State for visa processing. For more information, please contact them directly."
We did NOT request for consular processing. Does any one know why USCIS send my case to Department of State?

I need your suggestions on my situation and below is the same.
1. Priority date (04Oct2006) is current in June bulletin
2. Applied labor & I40 with previous employer.
3. Applied I485 in July 2007 ( applied I 485 before marriage) with previous employer
4. Joined other employer on Sep 2009
5. Not applied AC21 portability to new employer.
Now my priority date is going to be current as of June 1st, so need to file I-485 for my wife. Based on my situation could you please suggest the best approach to apply dependent's I485. i.e Apply dependent I485 from previous employer or through my new employer asking for AC21 along with employment verification letter).
Appreciate your help in advance.

I think if she didn't indicate that she intended to do CP in her I-140, but rather indicated she intended to do AOS in the US, then it will be a pain in the neck to switch to CP

Hello all,
My wife's labor has been stuck for 2 years ( she got an RFE ). Her company lawyers arent too helpful and asked us to just wait. Wanted to know, what steps one can take to try to figure out what is happening.

Hi,
I am working for a company who filed for my GC.
I-140 approved 18 months back
I-485 "applied and pending" 12 months back
EAD in hand from about 10 months.
If I move to a company with the exact same job description,
a) Whom do I need to inform, with regards to , AC21 portability clause
b) Who will check if the job is in the exact (same/similar) field
c)Possibility that there will be RFE after I-485?
d)What if the GC sponsoring company is not helpful after I move to a different company. How is this going to affect?
I need to weigh in the costs associated with countering a RFE and the increased salary due to job change.
Let me know your opinion.

My I140 (Bachelor degree, EB3, PD: Nov'04) was approved last month from my previous employer.
I completed my MBA in Jun'06 and joined another company; my job description has changed totally and I can't use previously approved labor for my new job. My new employer will initiate the process of labor, next week.
I checked with my previous employer and he informed me that he is ready to give me a support letter, if I want to go ahead and file I485 based on EB3 I140.
Questions:
Is it possible to file I485, even if we are not working with the employer?
Once I have filed I485 based on my EB3 I140, and if the application remains pending for next 6 months, is it still possible to port the PD (Nov'04) to the new EB2 based petition?

I have been on green card since June 2010.
I have visited India from October 17' 2010 to Feb 4' 2011 (Total 111 Days).
Now I need to go back to India again for around 3 months (Approx 10th May - 10th Aug) which is about 93 Days.
My questions are:
1. As a GC holder can I make the above visits without resetting my 'Continuity of 5 Yeard of Residence' clock ? As in each calender year I will not be out of country for greater than 180 days. But, when you count from October 16 2010 - October 15 2011, I will be more than 180 days out of the country.
2. If answer to the above question is NO, do I need to file/apply for any exception to be out of country?

Yes, you don't have to be in the US while the 485 is pending. You will need to be here for any appointments - fingerprinting, interview, etc. You also need to intend to be a permanent resident and work in the position listed on the I-140 (assuming this is an employment-based case). CIS might issue an RFE on the 485, asking for evidence of this, so you need to be able to provide it.

EB-485 processing times in NSC is FOUR (4) Months for the visa number available cases, and also pending EB-485 cases whose visa numbers are current and ready to adjudicate . So does this mean that cases with PD's not current but ready to adjudicate will get their I-485 approved by 6 months . Can some one please break it down for me .

Is there anyone whose I485 is pending for more than 90 days. My I-485 was sent on July 18th. I called USCIS twice and they are asking me to call them on Oct 17th (when 90 days is completed). They are saying that my appl.n should be in by then. Is there any one whose checks got cleared after 90 days. If not, what did you do about it.

Our AP expires on August 30 and we don't have any plans to travel this year. We have only plans for next summer.

but as far as the AD is concerned, an AD is for a position not for a person, if 1 AD satisfy the skill set and available position then one AD can work for multiple positions.
