Hi one of my relative has cleared the US citizenship exam. He is waiting for the oath. He want to visit canada after a month. Before the canada visit I think the oath will be done and he will become citizen of US. He can not get the US passport instantly.
My questions:
1. After becoming US Citizen can he visit canada without US passport? If yes what docs he needs to carry with hi?
If no then what to do ? asking because he want to visit canada and can not get passport withn 15 day.

Hi All,
I am developing an application in which I want to use Virtulaization in a Listview along with grouping of elements. The moment I apply grouping and Expander to my group in the Listview the virtualization thing stops working. I knw Virtualisation works on Virtualising panel and grouping implements stack panel and thus Virtualization stope working.
Is there any workaround for the same if there is please do let me know as the requirement is little urgent.

Can one work on 1099 when on EAD? My wife just received her EAD and am wondering if she can start working on 1099 or does she need to be on W2? Her 485 was filed based on my EB GC application

Will there be any problem if there is any address overlap in the addresses given for the last 5 years and outside US address for more than a year.
In my 485 application, dates of India address is overlapping with US address for 1 year. Will it be a problem, if it is how to correct it since my application was already sent?

Hi,
Me and my wife went to India and I came back one week back with my ex employer visa without any problem,I had to show only the I-797 for the current company where I am working. My wife she is still in India coming back to US in September.
I am sending my I-797 original to her in the mail.
My concern is will the immigration officer ask her for my I-797 approval or her I-797 approval ( she is on H4). We don't have an I-797 approval for her as my H1 was applied before we got married.My current H1 is expiring on Jan 19th 2009 so we applied for extension for both of us and got the approvals but its only valid from Jan 19th 2009.
Any replies greatly appreciated.

I renewed EAD twice using e-file. So far it was all smooth. Very first time I had paper filed and went for FP-ing. Since then renewed twice for myself and my wife - no FPing...got the card smoothly. Again this is USCIS .. someone might have had completely different experience...

I have worked for Company "A"(Ex-employer) under H1-B(company A holding my H1-b) from 2007-2010. During 2009 & 2010, company A was unable to clear all my payments as the company went through some financial hurdles but they issued W-2 for the amount paid in fiscal year 2009. Now, company A has got money and they decided to clear my back wages for 2009-2010 through 1099 form. I transferred my H1-B visa to Company B(2010) then to Company C(current employer). Now, Company C has started my Green card(GC) process.
Questions:
1. I already received W2 for 2009. Can company A amend the W2 for the back wages?
2. Is it legal to take the unpaid amount under 1099? Will it affect my GC process?
3. What are my options to get my back wages from company A?
4. Company A want to issue 1099 along with a letter stating that i was full time employee for the time period mentioned in 1099. Is it acceptable?
I really appreciate your help for taking your valuable time in clarifying my questions. I look forward for your reply.

> Traveling to US on June-15, 2011
> Planning to do a premium filing for an H1 extension once I am in the US - i.e. soon after June 15, 2011
1. Is there any rule that I have to be in the US for 8 weeks or so to apply for an H1-B extension?
2. Will there be some issue at the port of entry as I will have only 6 weeks left on my H1-B visa?

You can do anything (including doing nothing). However it is the norm to work for the sponsoring employer (or the latest employer if you used AC21) for 6 month to 1 year to ensure that no question arises in future regarding the legitimacy of the job offer based on which your GC was approved.

Yes, it is possible to obtain a Green card from L1B. However, you will have to undergo the Labor certification process (PERM application). Time wise there will not be a difference whether you apply under H1-B or L1B. It is only foreign nationals who are managers and executives on L1A status are eligible to apply for the green card without the labor certification.

Well, if you leave your co. now and also want your GC then:
Your H1 period will be over after 6 years irrespective of the I-140 from the old co.
GC: You do have to start from scratch.
However, you can still maintain your PD if your prev. co does not revoke the I-140. The documentation of your Old PD is to be attached with the New I-140.

There were two intervening vendors and the end-client declined to provide a letter stating that there is no requirement in law for them to provide any such letter. We had to get together convincing secondary evidence. I was highly doubtful we will get the approval, but we did. So, despite the January 8 memo from USCIS, there is life yet for consulting industry.
