My cousin from India has a BCOM degree and he is filing for a H1 B visa.
He just heard from his lawyer 2 days ago that his credit evaluation was needed and he had to get experience letters for atleast 3 years of work ex.
He gave it to his lawyer and now they tell him that they will submit his application without the evaluation! They said that once an inquiry comes if it even does then we will submit the evaluation.
Is that ok??? or should he be submitting the evaluation with the application. I am concerned but I guess it too late now.
Thanks for the help.

Hi,
I have the a situation where I need some advice:
I got my first job in june 2005 and was on my OPT until dec 2005. My H1-B was filed by this company and it started from Jan 1, 2006. Now I left the company in Sept 8 2006 and joined a consulting (vendor) firm. I am a contractor at Microsoft through this firm. This firm filed my H1-B on Sept 9, 2006. Now, 2 weeks back, when I checked the status of my case, I saw USCIS sent an RFE requesting more documents from my firm regarding the contract and type of job description. They gave a deadline until feb 2007 to submit docs.
My first initial contract length at Microsoft through this firm is until April 2007, but is more likely to extend for another 6 months.
Now my question is, since I cannot be sure if the contract will extend, I am starting to look for jobs...If I get a job, will it be alright to accept it and have that new company file my H1-B even though my current H1-B from my current firm is still in process and not approved yet?

LCAs for consultatnts definitely are challenging, since they move around so much. In your case, a new LCA is not required because the new position is in the same Metropolitan Statistical Area (basically the same town) as the old location.
In general, CIS and DOL distinguish between employees who are roving as part of their job, and those who are sent to a new location for a short term. The distinction is too complicated to go into here, but hopefully your company's attorney is well aware of it.

Youth-led organization United We Dream issued a scathing letter criticizing President Obama for using his recent speech on immigration as the basis for a fundraising ad. This week, President Obama addressed a crowd in El Paso, Texas regarding immigration Reform. DREAMers from across the country watched, waiting, and hoping to see a concrete action plan that would complement the next days historic introduction of a bill that would bring relief to the more than 2 million Dreamers that would qualify for the DREAM Act. That same evening, President Obama sent out a fundraising email about his immigration speech. The Obama...

Your I-485 will not go forward unti they receive the 140 approval.
I-485 petition will be undated automatically as soon as the corresponding I-140 is approved.
As far as I know, you don't have to inform uscis about your I-140 approval.
