    Will CIS Discontinue Intake of I- 485 Applications?

    It is possible. Such an action would be illegal, but CIS has already stopped accepting I- 485 applications for another category known as "Other Workers," despite June Visa Bulletin showing that category is current. My advice to all of you is keep filing all through the month of July. For all we know, they may never issue such an illegal policy or they might lose a lawsuit filed against them. So keep filing.

    USCIS updated the H-1B cap count for Fiscal Year 2010. It now has 45,700 cases against the regular (non-Master's) H-1B cap.     I have applied for AP (I131) on 8/14/09 and my I-485 got approved on 9/01/09. Is USCIS is going to return my I131 fee or is there anything I have to initiate from my end to get the refund?.

    Pls do let me know.

    Hi,

    Do you think the lottery will take place for 2010 year H-1B filing?

    zero I think...
    H1 filing follows the general employment scene, and with the current employment levels, and the relatively low levels of recovery being seen so far, the chance of a lottery seems almost nil....
    H1s for last year ran out just last week, why would 65k cases show up within a day just 3 months later?
    However I dont expect it to last till December 2010 like it did this year. Employment is going to slowly improve going forward, TARP H1 hiring restrictons dont apply to many banks...

    My I-140 approved in Aug 2007,My employer has withdrawn the I-140 in july but still it is approved in Aug 2007,Now my employer is agreed and want to sent the letter to USCIS not to withdrawn this I-140,As I am in Canada so they are planning to file the I-824 for me for Consular processing,so please advice do they need to file the new I-140 for me for Consular processing as they sent the withdrawn letter to uscis or is it ok for them to sent the letter again to uscis and telling them not to withdrawn this case and file I-824 for CP.Please advice!!!!!!

    Is there any body who have I485 filed at TSC and EAD and AP filed at NSC. If it is so, will that create problem in getting that EAD card? Since, they check 485 filing for EAD card production. Please advice.

    I applied for my EAD and AP extension on AUG 17 2009 and my EAD was expiring on AUG 29th 2009. While my wifes EAD and AP got approved, I had an RFE as I had not sent the recent photographs so I sent that and the receipt date for that was OCT 9 2009.

    I continued working and got paid, after speaking to friends I realized, getting paid on a Expired EAD is not right.

    I have taken a infopass to discuss this with USCIS to get an update.

    One more point I wanted to make was that my payroll company doesn't know about this and doesn't care. But if I bring it up then .they might immediately terminate my employment.

    How do I fix this? Please suggest.

    Hi All,
    I have a question regarding my wife's H1B Status.
    My wife got H1B stamped in hyderabad consulate last year. Due to recession, she applied for H4 to join me in US, got H4 stamping in hyderabad, during which
    H1 Visa was cancelled[expected..]. we have H1B Petition docs which says it is valid for 3 years. My wife came to US on H4.
    Now can't she apply for Change of status from H4 to H1 as we have petition docs, which are valid for 3 years?
    when contacted the actual employer, they said, when H1 visa is cancelled, it means, H1B petition also cancelled. Is it true?

    Please suggest.

    Online EAD status says Card production ordered. Not received card yet. Is there any memo/ lawyer opinion that says it is OK to work that as a basis for employment eligibility?

    You need to have the card in hand to fill in I-9.
