    Hi,
    I want to know weather can I apply AP for my wife while she is in US post it to India if she has to go to India before it gets approved.

    As there is the situation my wife need to go to India in July and I am planning to apply for her AP, can I send it over to her once the AP is approved or dose she need to be present in US at the time of approval.

    As far as I know, AP needs to be applied while the person is physically present in the US. Once it is applied and receipt notice has been received, the person can then travel. you can certainly send the AP to you wife in India.

    BharatPremi has brought up a good point. There needs to be some corrective action that needs to be undertaken here.
    At lease some of those that are absent from the meeting are not cowards as the core-team implies. We all know that.

    State level members can judge the organization better than core-team that receives a "feedback" from state level leadership.
    I have reservations about the style of texas leadership myself.

    If we are open, let us discuss it at state level.

    I had recent experience with continental the flight got cancelled but the staff was good they immediately gave me tickets to Virgin Atlantic (which was earliest departure) but I had Advanced Parole and so could not take VA.

    I think you misunderstood my previous comments then. I always knew that Democrats are pro amnesty/CIR. How could I argue against that ?

    Why the GOP is losing

    Entering the weekend before his midterms, George Bush and his party appear fated to lose the House they have held for a dozen years. The Senate is on a knife's edge.
    The latest polls continue to show that by 52 percent to 37 percent Americans wish to see a Democratic takeover. Approval of Congress has never been lower. Americans think the nation is on the wrong track. Support for the war in Iraq has collapsed to a third of the nation.

    What went wrong? Certainly, on three traditional Republican issues � strong military, conservative judges and lower taxes � the GOP remains America's Party.

    How do we know? Because no Democrat in a close race is calling, Mondale-like, for higher taxes or attacking Bush for elevating judges John Roberts and Sam Alito to the Supreme Court. In the tight Senate races in Tennessee and Virginia, Democratic nominees Harold Ford and Jim Webb are outspokenly pro-defense.

    On immigration, where Bush aligns with Kennedy-McCain, his party has abandoned him. The Republican House stands for border security, no amnesty and no new guest-worker program. Nor is this a losing issue. Even Hillary Clinton voted for 700 miles of security fence on the Mexican border.

    What, then, are the causes of Republican malaise?

    First is the perception the GOP is no longer a virtuous party that seeks to live up to principles and a high standard of public ethics. The adventures of the Abramoff Gang, Mark Foley, Duke Cunningham and his poker-party pals, of pork barrel and bridges to nowhere have demoralized the Republican base and disgusted Middle America. There is a feeling, even on the right, that if this crowd is run out of Dodge, its expulsion will not be unwarranted.

    Second, while the macro economy seems to be firing on all eight cylinders � the Dow has risen above 12,000, and the Misery Index of inflation plus unemployment has fallen to the lowest levels in modern times � not all Americans are participating in the prosperity.

    Employment in health care has grown by almost 2 million, but some 3 million manufacturing jobs have vanished. There has been a population explosion among billionaires, but the real median wage of a male worker has not risen in decades. The daily closure of factories here, as more and more Chinese goods show up at Wal-Mart, points to inescapable consequences: The price of the GOP's free-trade-uber-alles ideology is the loss of the Reagan Democrats.

    In Ohio, which was indispensable to Bush is 2000 and 2004, free trade is a millstone around the GOP neck. If Bush loses the House or Senate, free-trade globalism goes on the shelf. Not only will Bush fail to win congressional support of a Doha Round trade treaty, he will be denied any renewal of fast-track authority. The new Congress will not rubber stamp trade treaties, but demand a voice and votes on any new deal the Bushites negotiate on behalf of Corporate America.

    But if Republicans are swept from power, the reason will be Iraq. By two to one, Americans have reached the conclusion that the war was a mistake, that taking down Saddam was not worth the price in blood, that the management of the war has been as botched as John Kerry's joke, that it is time to bring the troops home and let Iraqis do the fighting for their own freedom, democracy and independence.

    And the more seats Republicans lose Tuesday, the greater will be the pressure on the party and president to find an early exit.

    Yet about the war, America remains divided and conflicted. For the roaring Republican reception to Bush's calls for "victory" testifies to another truth. While most American wish we had never gone in and want out, America does not want to lose the war as we lost Vietnam.

    Neither party knows a way to accomplish what America wants: to leave Iraq without losing the war. And the reason neither party knows how to do it is because it cannot be done. Like a patient suffering from cancer, we want an end to the "chemo" � the awful news daily coming out of Iraq � but we do not want the consequences.

    What, then, has cost the Republican Party its patrimony?

    The answer is, first, hubris. Dominating Congress for a dozen years, the GOP began to behave with the same haughtiness as those they displaced. They forgot who sent them here, and why.

    Second, ideology. Bush Republicans refuse even to reconsider, despite contradictory evidence, what their ideology teaches: that free trade is best, that U.S. power is invincible, that all the world wants to be like us, that our motives are always pure and theirs malevolent.

    Tuesday will bring the party back to earth. But it will not solve the crises that beset the country. For while the Democrats may be the political alternative, the Democrats' ideology of big government liberalism is even more bankrupt.

    Just a quick update I efiled on Sept 22nd 2009. Was assigned to LIN, Nebraska. Sent supporting documents the next day by first class mail. Received 2 copies of advance parole in the mail yesterday. Checked online this morning case was approved on October 2nd 2009. So basically from filing online to approval took 10 days total. I am amazed.

    I didn't attended because recently I had a new boss and he was monitoring my daily schedule and being in H1b and coming so close to filing I-485, I was just waiting for my EAD or I-485 cheques to get encashed. On 21st Sep, they got encashed. Now I am bold enough to take a day or two as vacation and attend rally if organized in eastern part.

    I did paid 50% travel cost to one of our member from CA.

    Sorry for not attending this time, will do it next time.

    hello all, could not attend due to work schedule and a baby due any minute!! but am contibuting monthly and sponsored a student from houston. way to go iv amazing effort!!!

    I was 100% determined in the beginning to attend the rally, but could not for the following reasons.

    1> I was in Dallas and family in SoCal for last 9 months(from Dec 2006 to be precise). I used to meet my family every other weekend. Was trying very hard to find a project in Socal, and finally I got one where joining date was Spet 13th. I could not dare to ask for leave in the very first week. To tell you the truth it took so long b'cos of H1 status, everybody wants me to transfer my H1 or they are looking only for GC/EAD holders. Hoping to get EAD soon.

    2> My husband was planning to attend but somewhere in Aug last week we got FP notices and date is Sept 18th. The FP letter clearly mentioned that postponing might cause delays so we decided that he also has to drop the idea.

    Of course we contributed towards the rally.

    I am very proud to be part of such excellent grass root organization and now since I am in Irvine I can be active in Socal chapter.

    Also we are eager to join in the next rally and have total faith in IV leadership

    Above excuses seem perfectly genuine to me. I had a court hearing myself. I applaud your friend's sincerity in attending the rally and I also applaud everyone who attended for that matter. But, IMHO, you were too quick to judge/question other people's genuineness.

    I don't know the history of BigTime007 postings. Maybe he has said some things in the past that lead to the ban but his most recent post which got him banned seemed just like venting and nothing more.

    What I do find annoying though is when ppl whose PD's are in 2006-2007 tell ppl rotting in BEC to "enjoy the ride". I have seen a few threads in the past where someone stuck in BEC was just venting and then ppl come along and tell them to "be happy for others". I don't get it. How is a person who is stuck for years, sees ppl with later cases get interim benefits, supposed to feel happy knowing they will still be stuck. :confused:

    I think all these poor souls are looking for is a few words of sympathy and company of ppl in similiar situation (not very different from ppl complaining about retrogression mind you). If we can not do anything to help ppl stuck in those blackhole let's not rub salt into their wounds.

    Lastly, regardless of whether you are stuck in BEC or expect to be stuck in retrogression for the next few years, there is no reason to be uncivil.

    I have had this query before. I had an H1B stamping on my passport for a company I never worked for. (Company A)

    But, when I applied for a H1B for a different company (Company B). My lawyer asked me if I ever worked for them and received any salary from them ... this was a RFE on my H1B case.

    All I did was replied to my lawyer with a negative answer to both questions (worked, salary for Company A).

    I got my new H1B approval I guess within 30 days of that RFE reply.

    You might want to contact a lawyer to draft a reply to USCIS though. I do not have a copy of the letter to provide to you ... Sorry!

    not be as simple as H1 renewal. G325 is pretty important form. The information provided on it is wrong. They could treat it as falsifying document.

    OP please contact your lawyer asap.

    Totally agree with you. I know guys who worked in production support and QA applied in EB2. At the same time people like me in positions such as Architect went with the ill-fated EB3. It is sad, but is the truth.

    Hate to burst your bubble. But you have an attitude problem. What makes you think that you are in architect position due to your superiority over others? I am also an architect but if the QA guys didnt fix your shit, your bridge would collapse on inauguration.

    Also depends, what are you really doing as an architect? Building a supply chain infrastrucuture for your company?

    I do undersatnd that these companies did not help you.. y don't u understand that we r not talking about u :) the statistics r these companies bring tens of thousands here every year from one country, yes on H1 or L1, not to sponsor them for greencards, but arriving here with a dual intent visa that allows for greencard application is not such a casual opportunity and that's what I'm telling you is rarely available to the equally qualified non-retrogressed folks. Once here, those thousands transfer to these small/mid size companies u mentioned and choose to stay and apply for greencards even though they know that with their huge numbers current rules will make their greencard journey longer..
    Yes adjusting the quota percentages should be on the table, but if these companies hurt you by creating a longer line than the quota allows, , then you should take issue with these companies before you take it at your fellow non-retrogressed immigrants.


    Hello! Infosys, Wipro and all those companies are NOT the main sponsors of green cards, which is the reason we're in this forum, no? Most of the sponsors are US based small and medium sized companies.

    I don't care how many visas they get, the fact is that it doesn't affect me! I neither have a job with them nor I benefited from them grabbing a bulk of visas. End of the day I'm held back because of where I was born.

    Look, this may be hard for you to understand, but just because those companies are in my country didn't and doesn't help me one iota. Everyone's on their own here.

    That is ridiculous. I never said that nor I will. The reason is because those companies MORE people exist in those countries, and THEY'RE CHEAPER and poorer, that's something I do expect you to understand.

    USCIS does not have to define "immediate availability" strictly on the cut-off dates listed in the Visa Bulletin. Rather, both State and CIS could post estimated "qualifying dates" on their websites so that, precisely as now happens in a consular case, USCIS would now allow pre-filing of adjustment applications so that applicants could begin to assemble the necessary documentation and send in their I-485 packages so that USCIS could conduct necessary checks and get the case ready for formal submission when the priority date is reached. Only at that point would CIS formally request an immigrant visa number from the State Department. Not until then would the adjustment of status be considered "filed". The beauty of this is that Congress need not lift a finger; all that need be done is for USCIS to modify the definition of filing contained in 8 CFR Sections 103.2 (a)(7) and 245.2(a)(2). If Congress wanted to ratify what the USCIS had done, it could certainly do so after the fact. Everything that we now consider to be the adjustment of status process could take place before the I-485 is "filed". Nothing could be simpler. The reason to seek Congressional modification of INA 245(a) is not because it is only way forward but because, by enshrining such a procedural benefit in the INA itself, it will be a much more secure right, one not subject to administrative whim or unilateral repeal. This process would not only afford the Visa Office a more accurate picture of adjustment demand but it holds out the potential of drastically slashing processing times. Far from granting adjustment applicants any special or unfair advantage, the use of qualifying dates as a way to define immediate visa availability would serve to harmonize the green card process in and out of the United States. Clearly, close and constant coordination between the Visa Office and USCIS would be required and integration of this procedural innovation with the Child Status Protection Act is transparently necessary. Given the obvious and not insignificant benefits, any transitional angst is surely worth the effort.

    The suggestion here is that it is pre-filing without pre-filing (if that makes any sense) i.e. it will enable USCIS to "look ahead" into a candidate's eligibility for 485 approval without providing any of the benefits (EAD,AP) that comes with filing a 485. It is supposed to help USCIS drastically cut 485 processing times with minimal upheaval, not give us any benefits.
