Including the House session and Conference session, if somehow this is pushed beyond October 1st 2007, then the enactment will happen on October 1st 2008. We have to hope for that. That gives best possible window for all BEC, PERM-BEC candidates and people who have not filed their I-140s yet.
The impact is on H-1B renewals beyond six years, with the cut-off proposed at six years. The only exception for renewal beyond 6 years is given explicitly to people who applied for immigrant petition. So BEC/PERM-BEC people should apply for I-140 asap.

First of all I would like to Applaud the Consulate General of India - Houston for the phenomenal speedy service I received for my daughters PIO application via mail. I sent my application on Oct 1st 2010 and it's Oct 15th - we have already received her PIO along with our passports back!! All the information about delays which I had read online before submission seem to be rubbish.
Additional info: notarizing passports was hassle coz no one was ready to stamp the photocopy. Texan credit union manager made a letter with my passport information, took my signature and notarized it for free. I just attached the photocopies with her letter.
I sent the below mentioned documents from Dallas via $20 Express Mail USPS - with signature proof. Was delivered under 24 hours. CGI Houston returned our stuff in FEDEX.
For status update: I called the consulate 7 days after the delivery notification - (yes its tough getting through - but they do pick up the phone) the lady informed me the PIO card had been processed and will be sent soon.. Didn't realize it would be in next 3 - 4 days!

You are right, nobody should force you do anything, everything is a personal choice, well only after you have attained a certain age (you don't have choices as a infant ;)). A certain person did mention that you like learning/ speaking english, probably even spanish (eventually :)), but you are uncomfortable because of the attitude of the speakers :), have you ever thought if your attitude is right ?, what make's you think your attitude is better / worse ?, just a thought bro, dont hate, life is too short to hate :)

This is not an attack post. Or a criticizing post. This is purely educational and please keep this thread clean.
I know there are many out there who are snickering in their cubicles looking at the pictures of the rally and thinking "Look at these idiots, they think Congress will pass SKIL bill because they walked 1.2 miles with some placards and banners".
Such thinking is reasonable. But only if you dont know how things work.
Here is why rally of Sept 18th will be consequential:
1. When you do a rally, people notice. People recognize organization and measure its strength. It stays in their heads for a long time and they keep Immigration Voice as one of the organizations they can ask for support when they push for their own cause. In Congress, things work based on compromise, consensus and consultation. People dont just sponsor legislations they believe in. They run it thru their caucus and leadership and do a vote count. To find out how many votes would they get if they came up with this new idea. Whether it will get 218 votes in House. Whether they will get 51 votes in senate. If its filibuster proof and get 61 votes in Senate. Whether it has committee support. Whether leadership offices are in agreement to put it in schedule. All this happens in background and there are people who are hired in committees just to do vote counts on proposed ideas. IF it turns out they dont find enough support, they drop it. If they think they can pull it off, they approach leadership (Speaker in House, Maj leader in Senate) to put it in queue.
2. Let us say that Congressman X wants to sponser SKIL bill because of his constituency or a senator (like Feinstein) wants to sponsor AgJobs because food growers are having food rotten in absence of agricultural workers, a compelling cause. Now, when they want to pass legislation, they have to look for support and votes as described in item 1. When they fall short, they find ways to sweeten the pot. IF they see that a powerful organization will throw in their support and lobbying in favor of their bill if they attach a few of that organization's provisions, then they approach them. Immigration Voice did 138 lawmakers meetings (in House and Senate). They did the rally. They would consider IV as a organization that can help them PUSH for their legislation. Now we have a place at the negotiating table. If they attach our provisions (like recapture, or GC quota increase), then we can promise to do something for them. Like support the entire bill they are pushing for. They know that we can do rallies and we can do hundreds of lawmaker meetings. If Diane Feinstein (just an example) thinks that by adding skilled employment based reform provisions she can get IV's support and swing a few votes to help her pass her favorite AgJobs bill, then we have opportunity where the Senator would ask us what we want rather than us going and asking them to do things for us. One of IV members said that on the day of the rally, suddenly the office of her senator called her and scheduled and appointment to meet the same day at 4:00 PM. She had been trying to get the appointment but after they rally and Roll call newspaper ad (http://immigrationvoice.org/media/forums/iv/rollcal3a.pdf), they called her to listen to her. I heard about this from her just as the rally was over.
3. CIR has recently failed. From some meetings, I got the feeling that CIR's failure has left a bad taste in mouth and many people in Congress as well as administration are very upset about it still. Now that we have done this rally, done lawmaker meetings, put a rollcall ad, did the media blitz, press conference, congressional reception (where 4 congressmen attended and spoke in IV's support), they know that it would be a good idea to keep IV on their side and put some of their things in a bill. Next time they write a bill (behind closed doors very often), they will consult us and ask us if they can do something for IV to win IV's full support. That's because by getting IV's support on their side for whatever they are doing, they can be assured that we wont oppose it but instead support it. With phone calls, Rallies, paid ads, lawmaker meetings etc. If they are really investing in getting a bill passed, they would include our provisions just to increase the odds.
Strength respects strength. If we have the strength to do things and make a difference (rallies, meetings, receptions, press conferences, paid ads), then that strength begets more strenght because other powers want us to join hands with them so that they can do their favorite things (AgJobs, DREAM etc).

Yes, USCIS IS capable of processing quickly (for example, my own case - but I'd say I was very VERY lucky, rather than an indication of system wide improvements). Remember, my GC was approved whilst my PD was not current, and I am still baffled why this happened. Having talked to many people about it, there is a strong suspicion of "squeaky wheel" helping.
Neah, there were too many approved to be all squeaky wheels. I think I know what they did. On July 1st they ran a simple query and picked up every application that has had no outstanding RFEs and had cleared namecheck, and then assigned them a visa number. If your receipt is from June, you may have cleared namecheck by July 1st, so you got the number. The rest (fingerprint check and approval itself) is just technicality.
I am on the opposite spectrum of the processing - been pending since early 2006 in EB2 ROW. My namecheck cleared late August - guess what, I am still waiting, perhaps until new numbers become available in October (even though I am current). Even though I have been waiting longer, they really finished working on my petition in June of 2006, so everything on the CIS side, including an RFE was done in 4 months. So, I really do not think your case is an exception. Most current approvable petitions that are not stuck in namecheck are approved in 3-4 months. So, in my opinion, quotas are the main culpit. Namecheck is easier to tackle because it gets a lot of bad publicity from delayed naturalization cases.

But if someone else requested this info broken into PD buckets by month and Year, then I think we need to use that. The letter I sent had that wording, but I never received any response yet.

There are certainly anti-immigration groups like IEEE/US and others who will use every weapon at their disposal to sabotage legislations like SKIL BILL etc.
I'm not sure about the assumption that IEEE/US is anti-immigration group. They have lobbied for the PACE act in Senate and STEM act in the house: http://www.ieeeusa.org/policy/issues/innovation/index.asp
Both of them are for skilled immigrants. I cannot imagine that they will sabotage SKIL bill.

Please help me out here. CIO of the company I am working now as a full time employee is quitting and forming a new company. He would like to hire me for this new company. This is a start up company with 15 Million investment and a big venture capital company from NJ is also investing in the company. Would you guys see any potential problems here for H1b sponsorship?

If I am supposed to contribute but do not then I am a shameful human. If I can't apologize for my inactions than I always will carry the guilt forever. If I am a free-rider knowing I am not supposed to be one than I do not belong to this IV team.
Maybe is better for me along with murthy's or Rajeev's forum. There I do not have to contribute, never be called shameful/coward and my weakness, integrity, self-respect, character, idendity, etc can never be exposed. The placement statistics from the Rotman school of Management website is quite impressive.
I've a few questions for you. How bright are the job prospects after doing an MBA from U of T in the current recession wolrd? Are part-time MBA students given equal opportunity in job placements? What's the % of placement among Canadian vs US employers?. Howmuch salary can a person with Engineering degree + US experience + Canadian MBA expect to get?
Placement statistics there are hyped up. Not that great. However the US ones are also hyped. So lets be fair here. US school dont tell
foreign students that without GC employers dont even want to look at you. Even Harvard foreign students are having a very bad time.
Plus here they allow spouse to work. If the marriage is more than 3 years , then that
spousal work permit leads to resident tuition as well. In US F4 cant work. Even you cant work off campus. Without working you have to support 2 persons (for married people)
Compared to Canada, US literally treats foreign students like dogs....I dont understand why people from India still come to do MS in US. Yes I know I have done MS in US and MBA in Canada....so I can compare first hand.
Let me be honest. Opportunities in Canada is no way compared to US for a US Citizen/GC.
However if you are not a US Citizen/GC then you are far better off in Canada.
Lately Rotman is a bit too expensive for non-resident tuition. So I wont recommend that to international students. However you can choose U of Calgary etc. I was a PR before I joined Rotman so I got loans, worked part more than 20 hrs week (often more than 30 hrs). Leaving H1B job in US for a MBA in Canada was one of the best decisions I have taken. In fact I was so convinced that I should not do MBA in US that I didnt even apply in
US schools.

PR and are close to getting PR Plus they get 3 year unrestricted work permit. It has been bad. But now I see eventually all are getting full time employment.
Part time students cant apply through the full time career center. But they can talk and annend info session. Most people including fulltime
MBA get jobs outside career center.
US experience isnt give a premium. Canadian experience is always prefered. 60K to 70K is the typical salaries that foreign students are getting. Well I never said that Canadian oppotunities are great but what i can say is that Canada is a better option if you are not a
GC/USC.
It is hard to compare Canada vs India. India as other problems. If you want finance sector jobs then it is Bombay. It involves long travel
of 2 hours in locals each way. 4 hours travel...there is no personal time left after work. I personally cant take it...it might be different
for others. Power problems, traffic jam etc is there. It about what you consider quality of life, and that is different from person to person.
I've a few questions for you. How bright are the job prospects after doing an MBA from U of T in the current recession wolrd? Are part-time MBA students given equal opportunity in job placements? What's the % of placement among Canadian vs US employers?. Howmuch salary can a person with Engineering degree + US experience + Canadian MBA expect to get?
Placement statistics there are hyped up. Not that great. However the US ones are also hyped. So lets be fair here. US school dont tell
foreign students that without GC employers dont even want to look at you. Even Harvard foreign students are having a very bad time.
Plus here they allow spouse to work. If the marriage is more than 3 years , then that
spousal work permit leads to resident tuition as well. In US F4 cant work. Even you cant work off campus. Without working you have to support 2 persons (for married people)
Compared to Canada, US literally treats foreign students like dogs....I dont understand why people from India still come to do MS in US. Yes I know I have done MS in US and MBA in Canada....so I can compare first hand.
Let me be honest. Opportunities in Canada is no way compared to US for a US Citizen/GC.
However if you are not a US Citizen/GC then you are far better off in Canada.
Lately Rotman is a bit too expensive for non-resident tuition. So I wont recommend that to international students. However you can choose U of Calgary etc. I was a PR before I joined Rotman so I got loans, worked part more than 20 hrs week (often more than 30 hrs). Leaving H1B job in US for a MBA in Canada was one of the best decisions I have taken. In fact I was so convinced that I should not do MBA in US that I didnt even apply in
US schools.

The problem is, that for all my efforts, people just don't seem to care. The only reason I had any success was the embarrassment I caused the government because of all the soldiers who were excluded. Immigrants in the US are viewed by most people as an unwanted scourge.
My employer has also been no help at all. I have been looking for work outside of the US, but unfortunately, the economic situation makes that a bit more challenging. Sorry if I sound pessimistic. That is just my personal experience.
I agree but that should not keep us away from trying. If it were not for HOPE then a lot of things would not have worked for people including the newly elected president.
I understand the frustration but at least we can use the same info and make it available to the relevant authorities. I think we will not loose anything as like last time we will be dropped again.

If we fight we lose once, if we do not we lose every time we don't. IV has nothing to lose if it can at least talk to a very good attorney. I'm not a lawyer but there could many ambiguous statements in it, and good attorney could make use of them to fight.
