I share your concern, there were more than 905 in that period, I don't think the DOL data sheets have any data for NOv 04 to MAr 05. I'm not sure of the source of the original post...

Mnay companies (I know few for sure) might not applied during that period (period of uncertainity). and even after March'05 many companies were reluntacnt to apply right away. They want to see how other cases turns out. Also note that till Sep'05 EB2- Ind was current so many EB2 cases approved approved in initail phase were also got approved before Sep'05.

it's very easy to make assumptions of how the system works in this country when people want a solution that fits their own particular needs.

Do some really exhaustive work of the history of immigration; the debates that happened when the laws got created; what has passed, what hasn't; what uscis/ice/dol is doing; request for evidence, denials, consulate refusals; underbidding of contracts, etc.; you may come up with different conclusions then what you may currently believe.
It's tempting but also very naive to lay the blame for immigration restriction via the country quotas on abuse. My views on this were shaped after reading the history on immigration to the US and the literature put out by the anti-immigration movement.

Hi,
I am transfering my H1b to my friends company. And I have to bear all fees. As such my case is simple, no complications. I have good education credentials and 10+ years of exp. Got education evaluation also with me.
I just went thru USCIS site and it looks like to me that filing H1 transfer by myself (or by my friend) is a fair simple job.
Can anybody give me advice or have some experiece in filing H1 or transfer H1?

Just a simple question. Corporations are arguing that every year 100k new jobs are created in high tech. Even 75% of the new jobs are for H1b then only 75k H1bs are needed. Even if you include other jobs teacher,Healthcare you do not need more than 120K every year Why do you need unlimited H1bs? Any pro immigrant lobbying group is not giving justification in numbers though everyone accepts there should be increase in H1b numbers.There should be increase in GC numbers as backlog had increased(But in this case also no one gave correct numbers based on requirement) but nothing wrong in H1b quota and some regulations in H1b to minimise abuse.
Another aspect is in the bill they gave 115k H1b for 2008. If they do not put restrictions your company cannot get any new H1b as most of H1b quota will be used by Indian consulting companies in one day. Do you think it is correct?
If not correct what is your solution? Corporation solution for this problem is unlimited H1bs by giving exemption to STEM and US master degree holders from H1b quota.
I am also opposing the restrictions in H1b program in the bill. But I do not have any alternative solution for the problems in the H1b program.

Can anyone guess where is the biggest talent pool? Nope, not in Bangalore, its right here in USA!! Not all companies are looking for the cheapest person. They are looking for the best person. And in many cases, the best person is already here, and has gathered more experience over the years working for US companies. But they cannot hire her, simply because she is on a visa and thereby beholden to another company. If she had a GC, that would free up the talent pool and thereby make many companies less reliant on H1Bs. Increasing GCs for EB candidates has the same effect as increasing H1 quota, with the added benefit of making the cream of the crop available and reducing the uncertainty and hassle of hiring an H1.
This is why it is in the best interest of companies to support EB GCs.
My friend Senthil makes the same mistakes (repeatedly, unfortunately):
(A) Assuming that "good" companies will not be affected by any change of increase in fees for H1B, since they presumably have unlimited pockets and unlimited access to unlimited talent. (Big ha!ha!)
(B) "Good" companies can always get to hire people in US if they exist, and the only reason they hire H1 is that they cannot find anyone in US as there is no one in US who is good enough for the job for love or money (Bigger ha!ha!)

This post does clarify visa recapture issues, but what about concurrent 140/485 filing ? Also, if our fate is still so tied up with 12+ millions illegals, doesn't that mean that we failed to make our case, even with so much media coverage, lobbying and our personal efforts to call the law makers. Could another explanation be that lawmakers have all but refised to treat us with dignity we deserved as an educated, law abiding, tax paying citizens contributing to the society. I believe that we didn't fail and we tried what we could but still lawmakers refuse to act on our casue, may be they are implying something without explicitly saying it ?

If Microsoft has not been able to get Congress to increase H-1B numbers, does it mean that Microsoft is no longer an effective corporation? Likewise, Immigration Voice has made significant progress but due to the political climate and statistical discussion about the undocumented, which of�course is different but an important issue, our provisions are clubbed in the comprehensive bill. Other companies/coalitions have stopped pushing for temporary H-1B increase as they do not want to be in the bad books of committee chairmen and the leadership offices by trying to sneak temporary relief that divides the supporters of CIR. Leadership wants support for CIR and want all sides to wait for CIR. And not doing so and trying to get interim relief before CIR would put them in bad books of Senate and House leadership, which no one wants coz if CIR fails, then after CIR, these offices will not co-operate with any group that tried to take away support from CIR. So it would be counter-productive politically to do things that take away good stuff from CIR. Also, if you think that any effort in the final week could help in anyway, then let me to share with you that most provisions and their language are decided much in advance and last minute efforts almost never yield any result on the Hill."

Doesn't it sound rude... they celebrate, feast and we fast. If we admire this country for giving us so much we should also show our support and adopt the culture and celebrate with them to show we are tax paying Americans who enjoy in American way.
We can show our protest by sending 1-wish for our own GC ( may be in the form of Christmas tree ornament) to all law makers. Everybody makes a wish and our wish is GC.

Obama's lack of experience does not bother me as much as Palins because you have to see what people have done in whatever experience they have had. Obama did community service, has had a strong moral fiber in whatever he has said. Palin has already abused whatever little power she had. Being a senator Obama has atleast been exposed to world-wide issues. I bet Palin cant even locate Georgia on the map. Did you see her recent interview? In spite of it being carefully staged, see her stumble aimlessly when it comes to the question of the Bush Doctrine... The biggest foreign policy change this country made (decision to make pre-emptive attacks) and Palin does not have an opinion on it because she does not even know what it is. The interviewer had to tell her what teh Bush Doctrine is all about. Are'nt you scared of a person like that leading the US? Why does this country always pick screwed up vice presidents (Dick Cheney's approval ratings have been <30% for as long as I can recall)
Either way, from an immigration point of view (focus of this forum) we are screwed (see my previous post for stances of both presidential candidates)
Republicans chose VP just to give them the edge. It doesn't matter to them if the VP-nominee is qualified or not or can be President in a heartbeat or not.
Selection of Cheney as VP lead to the outpour of financial support from oil and construction industries. More money, more power, more ads. They are playing dirty politics. So dirty.
Obama atleast has fundamental values that makes him a leader. Young as he is, inexperienced as he is, means he is not polluted by this dirty politics.
I'm really, really scared for all of us immigrants if McCain wins this election. When a Republican president is under control of the elites, that creates terror from within.
Maybe in the future when he is president, an i-485 denial notice for a person with no underlying status will be delivered personally by ICE officer, put a handcuff on the person, and straight to detention until the next flight back home. That will be the situation if we get a President under the control of few elites, extreme anti-immigrant, powerful Republicans.
McCain already backed-out from his CIR stance. He said categorically that if the same CIR, which he co-sponsored and voted YES, is put on vote today, he will vote "NO".

To add to this.. Some will think that something good just going to happen since next year is election.. Not sure what makes them think that..
Some are extremely negative-- They will say doesn't matter what you guys do,nothing will happen.
Those with negative opinions - they do not do much in life too - most of these wake up late in morning, go to work, watch TV , lazy in weekends , play cards, chat on phone , always spend a lot of hours on the internet researching for some crappy deals on electronic goods - the time, if well spent is worth more than what they save on buying the item.
Though it is difficult to change their attitude - it is possible, we must be persistent in our effort.

H1B visa is meant to be for people with skills that are in shortage in the US. If any H4 feels that he/she should be able to work, he/she should get a H1B. I agree that it may be difficult for some H4s to find a sponsorer for H1B, because their skills are not in shortage in the US.
Some spouses may join their H1B counterparts in the US, with an expectation that they will eventually get the GC and will be able to work, no matter what their skill set is. This is a reasonable expectation. So, blame the retrogression.
I do not believe that H4s should ever be allowed to work. They just take away jobs of more skilled workers who are unable to get H1Bs and who are still in their home countries trying for one. Skill-less free riders!
Now, please don't bash me with counter arguments!! ;)
sorry but this is ridiculous. If the US has a skill shortage and wants foreign workers, it should ensure that the foreign worker and his/her family are given the same rights that a domestic workers family enjoys.
If they can't give that right, why do they want to invite the foreign worker at all?
Its true that they are not forcing this on us and we are free to go back anytime. But still isn't the inequality pretty clear here? and this country is supposed to be all about equality...

San Jose was a local CA event planned almost spontaneously. DC was an event planned months in advance. People were offered Free ride, Free plane fare, Free food (in Gurdwaras). Yet how many participated?
I have been refraining from posting on this point, as I wouldn't like to belittle the contributions of the strong team from California and the numbers they brought to the rally.
But let's face it. CA has more EB immigrants than the next three. Look at the recent 2006 Performance report from DoL (available at Mathew Oh website). CA had 21,000+ labor petitions compared to NY - 7,000, NJ - 7,000(?) , TX - 5000. As you can see CA scores more than the next three states put together.
If 40 people participate from NY, it's as good as 120 from Cal. Percentagewise it would be the same. If 40 peope walk in Michigan ( 2000 Labor petitions) statistically it would surpass CA, percentagewise.
It's a known thing that only 5%-10% of the population participates actively in the most successful movements be it American Revolution or struggle for Indian Independence. We haven't reached that critical mass yet ( at the regional level)
There is an enthusiasm right now. But how long before the fatigue sets in? Rallies need to be minimal, held with certain strategic target and should serve some specific purpose.
Weekend rallies attracting bigger crowds is a myth. Be prepared to listen to reasons like - Shucks I have to mow the lawn, take kids to Bharatanatyam dance classes, I have relatives over for lunch etc.
With that logic if we hold rallies over the LONG weekends, we should attract bigger crowd, since people have 2-3 days to relax afterwards. And since people already plan to visit Orlando, LA etc to visit Disneyland, Universal etc., if we can hold rallies there we should attract the highest possible crowd. Do you think my idea will work?
I agree with you 100%. Question is - who'll bell the cat? Who will take the lead and sacrifice their time, family life etc. to plan, organize and conduct these?
We need a fearless leader like Aman Kapoor, who can motivate and inspire people to participate, in every state. Where can we find them?
The answer is we all will have to bell the cat...and it will take more than a few attempts to do that.
IMHO, we should focus on what we can do rather than focusing on what some people could have done or what some one did to dampen the last attempt.
People will always find time for what is important to them; all we can do is try to make it more convenient and keep giving then enough opportunities.
We should have some sales/marketing people on this forum; they could have told us about how long it takes to convert a prospect to a customer.

If 40 people participate from NY, it's as good as 120 from Cal. Percentagewise it would be the same. If 40 peope walk in Michigan ( 2000 Labor petitions) statistically it would surpass CA, percentagewise.
It's a known thing that only 5%-10% of the population participates actively in the most successful movements be it American Revolution or struggle for Indian Independence. We haven't reached that critical mass yet ( at the regional level)
There is an enthusiasm right now. But how long before the fatigue sets in? Rallies need to be minimal, held with certain strategic target and should serve some specific purpose.
Weekend rallies attracting bigger crowds is a myth. Be prepared to listen to reasons like - Shucks I have to mow the lawn, take kids to Bharatanatyam dance classes, I have relatives over for lunch etc.
With that logic if we hold rallies over the LONG weekends, we should attract bigger crowd, since people have 2-3 days to relax afterwards. And since people already plan to visit Orlando, LA etc to visit Disneyland, Universal etc., if we can hold rallies there we should attract the highest possible crowd. Do you think my idea will work?
I agree with you 100%. Question is - who'll bell the cat? Who will take the lead and sacrifice their time, family life etc. to plan, organize and conduct these?
We need a fearless leader like Aman Kapoor, who can motivate and inspire people to participate, in every state. Where can we find them?
The answer is we all will have to bell the cat...and it will take more than a few attempts to do that.
IMHO, we should focus on what we can do rather than focusing on what some people could have done or what some one did to dampen the last attempt.
People will always find time for what is important to them; all we can do is try to make it more convenient and keep giving then enough opportunities.
We should have some sales/marketing people on this forum; they could have told us about how long it takes to convert a prospect to a customer.

Here is what Attorney Mathew Oh thinks about provisions for STEM.
Section 406. Visas for Individuals with Advanced Degrees: Section 406 exempts from the numerical cap on employment-based visas aliens with advanced degrees in science, technology, engineering, or math, and has worked in a related field in the U.S. during the 3 year period preceding their application for adjustment of status.
[Matthew Oh Comment: This benefit appears to apply not only to the U.S. earned advanced degree holders but also to those advanced degree holders who earned the degrees in the foreign countries as well.]
It also exempts immediate relatives of aliens who are admitted as employment-based immigrants from the numerical limitations of 203(b).
[Matthew Oh Comment: Exemption from the numerical limitation of spouses and children of EB immigrants and exemption from the numberical limitation of advanced degree holders in science, technology, engineering and mathematics with 3-year employment in the U.S. would practically make a substantially large addtitional numbers available to the total EB immigration numbers beyond the total cap of 290,000.]
Finally, it increases the available visas numbers for H-1B nonimmigrants and provides an exemption from the numerical limitation aliens who have earned advanced degrees in science, technology, engineering, or math.

Experts,
I have done e-filing for my AP renewal. I read the instructions to see what documentation I need to mail,but I did not find any documentation specifically for e-filing. Does this mean that there is no need to send any documents? I heard USCIS will take picture during biometrics which is all they need. Can you please share your experiences on this. thanks a lot.

Logiclife's post may be a little strong in words. But it wasn't done with any ill-will toward anyone. Please remember it was borne out of frustrations borne out of some volunteers playing hokey at important IV events after RSVPing to attend and volunteer.
Naturally the organizer felt frustrated at the unexpectedly low-level participation at a very important event, for which significant personal sacrifice was done.
A word of advice to everyone - Do NOT volunteer to anything unless you are 100% sure you'll be doing it. Don't volunteer 'spur of the moment' to backtrack later. It's a rude and unprofessional conduct. We are all highly-skilled professionals here, right?
Take your time ( I mean weeks, a month or two, not 10-12 months of years !), become convinced about the IV cause. If you believe in it volunteer with full heart and conviction. And once you do, keep your words and promises. Don't make empty promises that aren't kept. It creates a very bad impression about you as a person. Not everyone will publish it here, but you'll be marked off as 'all talk, no action' from that point onwards.
If you expect others to respect you, please respect others first. Be professional and considerate in your conduct. If you cannot volunteer it's fine. Please don't make others lose their interest. For if they do and abandon the cause, you'll be a loser too !

We will not achive anything by this. Please do not post any name IMHO. Yes we have issues but nothing can be resolved by getting angry. All such posts are only going to aleinate those who are looking for a meanigful excahnge. Why get into mudslinging. When some one like 'logiclife' is expressing didain then he has full right to do so after having given so much to this cause. Let us all be the antidote to this issue by keep the process of encouraging/informing/inviting our friends/collegues after such experiences. Impatience will not get us anywhere.
