hey guys quick question...my existing AP just expired yesterday. however I had applied for AP renewal 120 days in advance and received an approval in Oct. The problem is the new AP that I received in Oct is valid from Oct 2008 until Oct 2009 even when I had a valid Ap until Dec 2008. So basically I lost 2 months when I reapplied for AP. Can I do anything to get 2 months added?

1. Two weeks pay that's it I need to leave the company which leads me to square one of GC processing(Having approved I140 with PD Dec 2004 in EB3)
2. I will be transferred to Indian operations of the same company ( I leaning towards this option) if I choose options they agreed to continue my GC, but since I filed for AOS is there any way convert my AOS application to consular processing?

Just like IRS will be mailing checks to provide stimulus to the economy, IV bills need the stimulus of your checks to move forward.Now that Stimulus checks are in the mail, it's time for the community to loosen the purse strings and contribute to something that will benefit you immensely.
Let's not let this historic opportunity go waste over a sum of $50 or $100, something many of us spent just to get to the nearest available USCIS recognized doctor for our AOS medical tests. If these bills pass the savings are much greater - EAD/AP/DL renewal fees, FP fees, AC21 fees (whenever you change the job) etc. Now that the new Medical form has been posted - with additional TB testing - old tests may be considered invalid after a period of time ( I'm not saying they'll be, but knowing USCIS anything's possible). Not to mention job opportunities lost due to a missing plastic card - every one of us, EAD users, has at least one experience, where we couldn't apply or were denied opportunities for not having GC.

Lets not fall victim to self-defeatist pessimism and thriftiness. Good post. Politics is a game of give and take. One thing legal immigrants should learn is not to distance themseves too much from the cause of illegals. If we support DREAM act, they will support SKIL bill. If we support admission bar repealed or 245(i), they will support higher numeric quotes and not counting of dependents. Think about it, our common goal is the same - to have a fair immigration system, where every desrving person has a chance to come to this country legally and with dignity.

As so many members have posted there is no such thing as H1 transfer. If OP continued to work for employer# 2 without joining employer X that is fine as long as OP's employer 2 did not revoke the H1 petition. So OP should be fine , all he has to do is point that he did not accept employer X offer and decided to continue with current employer (i.e. #2) and his work with employer 2 was authorized based on the continued validity of h1 petition of employer 2. Now I saw that OP mentioned somewhere that he used EAD when his H1 with employer 2 expired. This could be a potential reason for the RFE. Here's my take on it:
When OP's H1 ultimately expired there were two possible work authorizations which OP could have used : Join the employer X on H1 since that employer did not revoke the h1 petition even though he did not join them OR used EAD with either employer 2 or employer X. The OP got this RFE for I-485. If you are doing AOS from H1 the burden is on you to prove that even while your I-485 is pending you have not engaged in unauthorized work. I just feel that the IO is doing an extensive scrutiny of the OP's application and trying to make sure that OP did not engage in unauthorized work at point.
In any case the OP should get a good lawyer.

I talked to many representatives regarding my I 140 filing from yesterday.
This is what all msot all of them said.
Nebraska center is running behind with their schedule in generating their receipt numbers.
First all the applications go to the mail room. If everything looks fine with the application, the mail room people would send the cheques to be enchased. This normally takes like a day or 2. Then they send the applications to a different department where the clerk needs to put the information in the system and generate the reciept and mail it out. All this process should normally take, 5 to 7 days and Nebraska Center has a turn around time of 15 days.
But Nebraska center is backlogged a bit due to the numerous applications they recieved, till last week for I 140's. And a decision was made yesterday that, the Nebraska Center would catch up generating all the receipts by August 1st. (Thats what the reps told me). So everyone's receipt number who filed their I 140 by July 16th should be available in the system by August 1st(we wud complete the 15 days turn around time too). And if they get mailed out by then, we may recieve in a week or so, by Aug 10th.
So everyone will be good to go. Even if you dont get the receipt, your checks would be enchashed by then which will have a receipt number and you can call the USCIS office to confirm that receipt number (as they will have it in their system by August 1st) and just file by putting the copies of those checks.
Its not our problem that they delay the receipts.
But I hope that everyone will get their receipts by August 10th. So just chill out and relax.

My Own Case:-> I work for a multibillion dollar telecom company and joined this company almost 15 mos ago with a promise that they would start my GC immediately. Till Now, they have not yet file my labor. Their lawfirm is Larrabee http://www.larrabee.com/ in sanDiego. I don't have much experience with them as my application is still in my company's internal queue but based on the basis of my little experience, I would certainly not recommend them

Doesn't it sound rude... they celebrate, feast and we fast. If we admire this country for giving us so much we should also show our support and adopt the culture and celebrate with them to show we are tax paying Americans who enjoy in American way.

Congratulations for all that fight for so long. I just can�t believe all EB categories are current.
Sorry for my inexperience of GC process. I am a newbie and have couples questions.
1. My husband�s LC is approved. Attorney is preparing I-140 (may submit it already), since the date is current. Does that mean we can apply for I-485 at the same time too?
2. Once submitting I-485, can we leave the country? We have to go back to home country for my husband�s dad pass away 1 year memorial. We have to make that trip, so should we wait until after the trip to submit I-485?

In which case, the employer is accountable for the employees. If the employer is honest, there will not be any employees who can take advantage of the employer's crookedness.
So, if there are a few good employees (which will be rare), they will have to bear the brunt. Kind of collateral damage. I feel sorry for those people, but I don't know what we can do about them. I'm sure that fraud employer is taking advantage of them too.
