Airline industry has changed a lot. People still asume that travelling on a plane is something aristrocratic. Not any more. Airline industry has realized that mostly what consumer cares for is "price" and also that most of the travellers are "obligatory travellers" particularly on international flights. So the rules have been written with lots of ambiguity and also since international travel involves multiple countries the legal battle is also not often successful against the airlines. Another thing is that most often people purchase tickets from agents and not directly from the airlines and often there are multiple airline cariers involved in international flights. It is a very complicated issue and it is kept that way so that the consumer has litterally no way to complain.
My advice; Treat airlines just like a cab. Dont expect good treatment from the staff and dont respect them either. Dont behave as if you are in a 5-star hotel once you enter the airport instead feel that you have entered a railway station which is the least predictable. Enjoy the fun if your flight is on time but dont always plan to be on time. Forget eating good food on flights and dont argue if you get bad because that is what it is most of the time "bad". Good behaviour from the flight attendents / customer service...No not at all. I dont expect them to behave properly at all. If one happens to deviate from the norm and behave nicely I just smile back and acknowledge the craziness.
Finally; If you have decided to take a flight to somewhere remember to enjoy all the rest of the trip and be prepared for the worst part of it that begins the moment you step into an airport and get out of the F****** place. People people people when are you all going to get it. airport and flying is no longer luxory. It is just the cheapest thing we are forced to do during our busy lives.

because for people from Aus, their spouses can work.
There is a different visa category for australians called E1, only THOSE ppl's spouses can work. If an australian is on an H1 his wife cannot work on an H4 either.
In that case you also have to argue, why H4's cant work but L2's can? :)

Alongwith permission for H4 to work, there are several other problems that legal immigrants face in USA. However, lets face it ... its always a small set of people who are fighting for their green cards. After a prolonged wait, once they get the GC, they move on with their life, forgetting their own ordeal in the past, and ignoring the future problems of fresh GC aspirants in the queue.
Even the fresh GC aspirants who come to USA on H1/L1 visa, do not understand the importance of staying on top of their GC application and start organizing themselves. Mostly they realize the gravity of situation couple of year after their arrival, and start venting their anger and frustation on immigration forum like this.
A majority of immigrants think that the immigration doors should shut down immediately after they get their GC's. This transformation takes place overnight. I have never heard that from such a large population of immigrants who are settled in USA, anyone ever raised their voice supporting the legal immigration.
Lets face it ... its an unjust world ... we have lots of problems as far as legal immigration is concerned. But how many of us who are boiling with frustation here, will ever work and spend our time and energy on immigration related issues once we get the green card/citizenship?
BTW, I am just throwing some light on the basic root cause of this problem... no war of words please ... just peace.

It does make sense that the overflow numbers are given to higher preference categories in single state oversubscribed countries. When you think about it, will that not be the most beneficial to United States? Who would you prefer .... and Unskilled professional from a ROW category or a skilled worker from an Oversubscribed country. I would gather it would make more sense to give the opportunity to the higher skilled since the benefit to US will be higher

Update: subsequent to the change in deadline we have redoubled our volunteer efforts in Northern California from once a week volunteer work to twice a week, volunteers on the ground effort. this effort entals that volunteers actively approach High-skilled legal immigrants for support for this admin fix campaign.
We are excited about this and are getting more traction as more people hear about this. The best way to motivate others is to do it yourself.
PS: the number of letter on the first page are understated. Abhijit and Digital have updated numbers. Growing by the week.

My experience is that whether an attorney is good or bad depends on the size of the sponsoring company. My boyfriend was working for a big company and got a really great service with Ogletree Deakins who have offices all over the US. When I was experiencing problems with my attorney, he highly recommended Ogletree and my employer contacted them, and our experience was really bad - they promised a lot of things, then realized it was a small company and was not so interested anymore.
That's why after LC got approved, we decided to file everything pro-se. We have had 3 different attorneys. My case started in 2001 and got stuck in BEC and a PERM case was filed to try to capture my PD from 01, and by looking at my signature you can guess what happened. So, lots of experience with attorneys, not one that could recommend.

That is right. But same country quota is there in EB system also. So in point system also 80% of people will get same quality of people as current system. But advantage is process delay will be eliminated.
The points system will likely result in significant deterioration in the quality of EB immigrants.
The biggest flaw of the point system as it is currently structured is that people may be able to get a green card even if they are unemployable in the US. No one knows what fraction of green cards granted under the points system would end up going to these types of cases.
As it stands today, 100% of all people admitted under the EB categories are assured of decent employment when they are granted a green card. Why should we move to a system that permits people to come in based on paper qualifications, work for low wage jobs and then after 5 years claim welfare benefits?

Hi kate123, either it is a legislative fix or not, it's not up to us to decide. I saw the danger of our time and effort being sidetracked by trying to argue whether it's a legislative or administrative fix. The new secretary has made it clear that she is willing to push for BOTH Administrative AND Legislative fix if it's deemed necessary. Our goal should be bringing enough attention to her on the pre-application issue and convince her it's a meaningful change that will help both the DHS and the applicants, so she will push for changes. Please let me know if you agree.

Ok, taking the emotion out of proposal, i agree fully with this post.
My application with PD 2003 was stuck in BECs for more than 2 yrs. There were cases being approved in a random fashion - unfortunately, we were not organized to put enough presssure to sort out the mess and ask the BECs to follow some sane procedure.
Now that we are at the 485 stage, I think it makes a lot of sense to first try and urge USCIS to follow a simple PD+RD procedure. If the PD of a case is earlier, than adjudicate it first. Plain and simple.
I'm also happy for the greater good and the fact that people who got their labors cleared as late as 2007 are able to file for 485. The 485 filing problem, namely, being able to when PD is not current is on IVs agenda anyway and a top priority. But for people to just jump the line is more of a selfish act than 'risker' starting this thread.
Btw, I don't see anything wrong with this thread, it is not a selfish agenda. We should work together to lobby and put pressure on USCIS to make this simple procedural change of using PD and not Receipt Date. It is fair and makes absolute sense.

1. Why don't we petition first before thinking of Lawsuit. We from IV should write a letter to USCIS stating the injustice brought to the backlogged victims and how it is mentally affecting them etc. We should ask USCIS to consider these things and come up with a solution for backlogged victims instead of threatening DOS and others with Lawsuit. Since we are at their mercy, there is nothing wrong in keeping them higher up and at the same time getting what we want.
2. If the petition did not work out, then we can think about some suit. Still I don't agree with any suit as it is not going to bring justice. By the time the suit clears, you will have your GC in hand.
