I was wondering if there is any documentation that we can show the employers to dissuade them from revoking I-140 when leaving the petitioning company...

I am confused. it is very contradicting.
That's why there is a saying that you should never watch sausages and laws being made.
The Cantwell amendment and Lieberman amendment will fail to pass the vote. It doesnt matter whether its ordered to lie on table or whether its ordered to take a nap on the table or have some lemonade on the table. And it doesnt matter what any of those "Motion to... " means.
Both of those amendments, if debated, will fail. It will take 10 seconds for Bernie Sanders, Ted Kennedy and Dick Durbin to scream on top of their lungs and kill it. And the reason is very simple. There is a massive H1B exemption ON TOP OF 180,000 QUOTA. People who have been so successful this year so far in restricting H1 and employment based GCs are not going to miss that nice little H1 exemption at the bottom of both these amendments. So stop scratching your heads over what the "lying on table" means, because whatever is lying on table is unpassable if it somehow awakes from the table and starts dancing in the well of the senate floor.

I BEG to differ. I called USCIS today morning and the rep told me VERY CLEARLY that ANY application received on July 2 will be ACCEPTED as July 2 is the cutoff.
A few min later my spouse called and they told her, Everything would be rejected.
USCIS customer service center, currently cant differentiate their A** from a hole in the ground!!

I think they misplaced AC-21 application and also they missed NOID step. This is basically two mishaps.

ARE THEY SENDING EVERYTHING TO THE OLD LAWYER???
If they never updated the lawyer info....(AC21 papers being lost is not unusual at all, it happens commonly, as there is no set form for it, mail room does not know what to do with it and so it gets misplaced). However, even if they did not have AC21 info, they would have sent an RFE or at least NOID. All these could be LOST if they went to OLD attorney.
So Infopass is a good idea. To at least get this info and also to get the actual denial notice which may have to to the old attorney as well (to see on what grounds they denied it so you can file MTR accordingly).
Of course, a good attorney is a must.
All in all, I think, it should be ok at the end of the day (just a painful waiting period full of uncertainty) unless they revoked it based on some misrepresentation.

The Supreme Court has defined these levels of scrutiny in the following way:
Strict scrutiny (if the law categorizes on the basis of race or national origin or infringes a fundamental right): the law is unconstitutional unless it is "narrowly tailored" to serve a "compelling" government interest. In addition, there cannot be a "less restrictive" alternative available to achieve that compelling interest.
In Bakke, the Court held that racial quotas are unconstitutional, but that educational institutions could legally use race as one of many factors to consider in their admissions process. In Grutter and Gratz, the Court upheld both Bakke as a precedent and the admissions policy of the University of Michigan law school. In dicta, however, Justice O'Connor, writing for the Court, said she expected that in 25 years, racial preferences would no longer be necessary. In Gratz, the Court invalidated Michigan's undergraduate admissions policy, on the grounds that unlike the law school's policy, which treated race not as one of many factors in an admissions process that looked to the individual applicant, the undergraduate policy used a point system that was excessively mechanistic.
In these affirmative action cases, the Supreme Court has employed, or has said it employed, strict scrutiny, since the affirmative action policies challenged by the plaintiffs categorized by race. The policy in Grutter, and a Harvard College admissions policy praised by Justice Powell's opinion in Bakke, passed muster because the Court deemed that they were narrowly tailored to achieve a compelling interest in diversity. just fyi...it took fragomen 6 months just to start the recuitment process ...they are really slow. but they are quick in getting back to you on your day to day requests.
My company started the PERM process for me about 2.5 months ago. I contacted Fragomen about 1.5 months after approvals within the company and they said they are working on establishing min requirements for the position. I then contacted them 3 weeks after that day and they said they have established the requirement and will request the DOL for prevailing wage info (this was 2 weeks ago). My company started the PERM process for me about 2.5 months ago. I contacted Fragomen about 1.5 months after approvals within the company and they said they are working on establishing min requirements for the position. I then contacted them 3 weeks after that day and they said they have established the requirement and will request the DOL for prevailing wage info (this was 2 weeks ago). After which they are going to start the recruitment process. So I'm not sure if the time line is okay or should I be chasing them more frequently? Please advise.

If we are educated and highly skilled that doesnot mean that we deserve automatic benefits.
In USA, political system works on coalition. If you help others then they help you in time of need.
How many of us have helped others without thinking "what is in it for me". I have seen people who are stuck in FBI Name Check and they dont help people with F1, H1, GC issue, so when one gets what (s)he wnats, everyone else is ignored.
If we want to stay in USA, then we have to leave our sofas and help other ogranizations in their cause. you don't have to agree with everything they say, but some things can always be agreed upon.
This is what I learnt from Congressman Keith Ellison.
So be part of political process at every level..city, state, etc..
Then when time comes and you need help, you will have people behind it..

:eek: I am not sure whether it is my HR to be blamed or my corporate law firm TheChugh who has been handling my case, no one has bothered to convey my PERM status or even my case #. I feel frustrated when my HR doesn't respond about the status.
I understand that they must by flooded with application preparation but setting up a link for me to check the status shouldn't be very difficult.
I really hope that my PERM gets approved before 31st July so that I can file I-140 and I-485 concurrently.
Anyone else has experience to share about TheChugh law firm?
Even I have some bad experience with CHUGH Firm..They are really slow and never talk...I think they don't pick the call even if they are around...
I'm not sure if my employer's told them not to respond to my mails..anyways itz very tough to get things out of them...
and one thing I did'nt like in them is that they lie right on ur face !!

This discussion is very valuble for people like me deciding between living in Canada as PR vs H1B USA .We all know that salaries in USA are slightly better than Canada .But now the exchange rate is almost equal.
Salary:
Can a person with family(2 kids) survive in Canada with CAD 50,000 / year salary in a place like Toronto.? I heard in Canada you pay 13 % tax on anything you buy .Does 50 % of your income goes in taxes ?
HealthCare:
Also is the government sponsored health care good compared to USA .I mean do you have any wait to see specialists.Is healthcare comparable to USA .
Immigration:
In USA anyone can get a Greencard regardless of their qualifications and it depends how early you enter the GC queue.But looks like in Canada they value your educations and other qualifications.Can IT professionals (non-managers) apply for Canada PR without a job or canadian education?
Canadian Citizenship:
Many people want to get Canadian citizenship and return to USA with TN Visa .In future ,could USA put restrictions on this .?
Please share your thoughts .

I am in a lot of stress. Please help out if possible.
Six years on my H1B expire in April 2008. I just got laid off from company A. My last day of work will be May 31st. I have LC and I-140 approved with company A.
If I join company B starting June, and transfer my H1B to B, can it extend my H1B beyond 6 years based on the approved I-140 I had with company A? If yes, will it be for one year or three years?
Gurus please help. I will be grateful.

Don't worry..you still have time..start hunting for a job and you can transfer and extend your H1b for 3 years based on I-140 approval(beyond 6 years).
